The United States Citizenship and Immigration Services (USCIS) announced that it will be resuming premium processing services for pending FY 2019 H-1B cap cases starting on Monday, January 28.
Since April 2, 2018, premium processing had been suspended for FY 2019 H-1B cap cases and was expected to remain suspended through February 19, 2019. Premium processing remains suspended for H-1B change of employer, amendment, and non-cap subject change of status. However, premium processing continues to be available for extensions of H-1B status with the same employer that do not involve changes in circumstances, H-1B petitions filed for employment with or at qualifying cap-exempt organizations, and other non-H-1B case types that are ordinarily eligible for premium processing.
Employers with pending FY 2019 H-1B cap cases now have the opportunity to request premium processing service for these pending cases. Additionally, employers that are preparing responses to Requests for Evidence (RFEs) from USCIS for FY 2019 H-1B cap cases can include a premium processing request and fee with their response to request premium processing.
