The United States Citizenship and Immigration Services (USCIS) has announced that it has received a sufficient number of petitions to reach the congressionally-mandated 65,000 H-1B regular cap for fiscal year 2020. USCIS will then determine if it has received a sufficient number of petitions to meet the 20,000 H-1B U.S. master’s cap.
At this time, USCIS will reject and return filing fees for all cap-subject petitions that are not selected and that are not prohibited multiple filings. USCIS will continue to accept and process petitions that are otherwise exempt from the cap, such as petitions filed to extend the amount of time a current H-1B employee may remain in the U.S.
