On May 3, 2017, USCIS announced that it has completed the data entry of all fiscal year 2018 H-1B CAP petitions that were selected. All H-1B CAP petitions that were not selected will begin to be returned. Unfortunately, the high volume of H-1B CAP filings prevents USCIS from providing a definite timeframe for when to expect these petitions to be returned. Once all petitions that were not selected have been returned, USCIS will issue an announcement.
In order to balance the distribution of H-1B CAP petitions that were selected, the USCIS is in the process of transferring several H-1B CAP petitions from the Vermont Service Center to the California Service Center. You will receive notification from USCIS if your H-1B CAP petition has been transferred.
Premium processing for all H-1B petitions is still suspended for the six month period beginning March 3, 2017. Therefore, any Form I-907 Request for Premium Processing Service filed with any H-1B petition during this six month period will be rejected by USCIS.
Our offices will keep you informed of any further announcements from USCIS regarding the FY 2018 H-1B CAP.
