A new Presidential Memorandum directs the Department of State (DOS) and Department of Homeland Security (DHS) to provide recommendations to tighten B-1 and B-2 visitor visa enforcement.
Specifically, the Memorandum directs DOS and DHS to do the following:
- Recommendations regarding Visa Waiver Program: Within 180 days of the Memorandum, DHS must report to President Trump on its efforts to reduce Visa Waiver Program overstays and provide recommendations for further enforcement for this program.
- Recommendations regarding targeted enforcement: Within 120 days of the Memorandum, DOS must provide President Trump with recommendations to reduce B-1 and B-2 visa overstays from countries with overstay rates over 10%.
- Immediate action to reduce overstay rates: Within 120 days of the Memorandum, DOS and DHS are ordered to develop measures to immediately take action to reduce the overstay rates of all types of nonimmigrant visas, not just B-1/B-2 visitor visas.
