On August 15, 2019, the United States Citizenship and Immigration Services (USCIS) announced that it has finished returning all H-1B petitions that were unselected for the FY 2020 cap. Petitioners should receive their returned petitions with filing fee checks by August 29, 2019.
Meanwhile, USCIS continues to adjudicate pending H-1B cap cases for FY 2020 as well as issue Requests for Evidence (RFEs). If an employer submitted an FY 2020 H-1B cap-subject petition that was delivered to USCIS between April 1 and April 5, 2019 and does not receive a receipt notice or a returned petition by August 29, 2019, they may contact USCIS for assistance.
